Rassegna trimestrale n. XVI-3 | Luglio 2025
Il numero di luglio 2025 della Rassegna trimestrale raccoglie riflessioni sullo stato e l’evoluzione della produzione normativa in Italia e in Europa, con attenzione agli strumenti di semplificazione, alle pratiche regolatorie innovative e alle valutazioni d’impatto delle politiche pubbliche.
Apre il fascicolo il contributo di Valerio Di Porto, che presenta il Rapporto sulla legislazione tra Stato, Regioni e Unione europea 2024-2025, con dati aggiornati sulla produzione normativa e una comparazione tra Italia e i principali ordinamenti europei. Il Rapporto evidenzia, tra gli altri, il crescente ruolo della decretazione d’urgenza e l’importanza del raccordo tra livelli di governo e policy europee.
Seguono tre saggi che esplorano il ruolo dell’“Agile regulatory governance” e della sperimentazione normativa, le Zone Economiche Speciali (ZES) come leve di semplificazione amministrativa e la riforma della disciplina AIR presso l’ARERA. Particolare attenzione è posta all’introduzione della ZES unica per il Mezzogiorno e ai nuovi criteri adottati da ARERA per una regolazione più partecipata e basata su evidenze.
Chiudono il numero due contributi sulla valutazione ex post delle politiche pubbliche e sull’impiego dell’AIR nelle politiche di contrasto alla violenza di genere. In particolare, si analizzano i casi dell’INPS e le difficoltà nell’uso sistematico di dati e metodi valutativi, nonché l’efficacia degli strumenti AIR in ambiti caratterizzati da interventi emergenziali e repressivi.
L’introduzione al numero di luglio 2025 della Rassegna trimestrale, a cura di Paola Coletti e Gianluca Sgueo, presenta i temi principali attorno a cui ruotano i contributi pubblicati. Gli editor sottolineano come la riflessione si concentri sull’evoluzione della produzione normativa in un contesto multilivello che coinvolge Stato, Regioni e Unione europea, con un’attenzione particolare alla crescente integrazione tra politiche pubbliche e strumenti legislativi. Abstract (EN) | The Regulatory Impact Analysis (AIR) is a tool used by ARERA to improve the quality of regulatory decisions. The new discipline, in force from 1 April 2025, introduces more selective criteria for the application of the AIR, enhances internal skills and adopts advanced investigation techniques. Abstract (EN) | The ex-post evaluation of public policies has been applied by the National Institute of Social Security to study the effect of two public policies. Firstly, the effect of the Citizenship Income on birth rate has been estimated through the Regression Discontinuity Design.
