Biden Administration Digest: Impacting the concept of regulation

After his election, President Joe Biden has adopted several measures impacting the concept of regulation. In particular, he signed the very famous Modernizing Regulatory Review Memorandum in which he “directs” the Director of the Office of Management and Budget (OMB) to work together with other executive departments and agencies in order to produce a set of recommendations to improve and modernize regulatory review.

Moreover, he signed an Executive Order to revoke some previous executive orders regarding regulation. Such orders could “threaten to frustrate the Federal Government’s ability to confront [problems regarding the] pandemic, economic recovery, racial justice, and climate change”. He also signed the Executive Order to improve public health and protect the environment.

Finally, he signed the Restoring Trust in Government Through Scientific Integrity and Evidence-Based Policymaking Memorandum. President Biden stated that evidence-based decisions should be guided by good quality data and science. Therefore, it is necessary that Federal scientists and other scientists are kept safe from “improper political interference”. Emphasis is also placed on the role of Director of the Office of Science and Technology in ensuring the highest level of integrity in the executive power engagement with scientific and technological matters and in convening a “Task Force” that could review the effectiveness of previous agency policies related to scientific integrity.
