La nostra Rassegna trimestrale: il numero di aprile 2021

Il numero di aprile 2021 della Rassegna trimestrale dell’Osservatorio AIR viene pubblicato in concomitanza con la conclusione del primo anno di emergenza pandemica (che ci auguriamo resti anche l’unico) e non poteva che essere dedicato alle sue implicazioni sulla regolazione, a più livelli.

Attualmente sono in corso otto iniziative di ARERA, AGCM, ART, Banca d’Italia e IVASS.
Segnaliamo, in particolare:

  • ARERA, Primi orientamenti per la definizione del metodo tariffario rifiuti per il secondo periodo regolatorio (MTR-2). Termine:11 giugno 2021.
  • ART, Delibera n. 154/2019, Allegato A – Misura 12 recante “Obblighi di contabilità regolatoria e di separazione contabile per i CdS di trasporto pubblico locale passeggeri su strada”. Termine: 14 giugno 2021.
  • Banca d'Italia, Disposizioni in materia di sorveglianza sui sistemi di pagamento e sulle infrastrutture strumentali tecnologiche o di rete. Termine: 30 giugno 2021.

The Board independently scrutinises the drafts of all impact assessments and fitness checks, and a selection of evaluations. It reports on its activities to the President of the Commission and to the Vice-President for Interinstitutional Relations and Foresight.

ACUS, ACUS Committee to Consider Periodic Retrospective Review, in ACUS Blog
The project, Periodic Retrospective Review focuses on how agencies can carry out regulatory review on a more regularized basis. The project aims to produce a set of recommended best practices for the consideration of ACUS’s full Assembly at the June 2021 Plenary Session.

The Congressional Review Act is not the only mechanism that incoming presidential administrations have to reverse the regulatory agenda of the previous administration. In the case of regulatory rollbacks, the Biden administration has been actively using several options to reverse Trump-era rules, including withdrawals, regulatory suspensions, strategic responses to litigation, and other executive actions.

European Commission, Public consultation on a set of European Digital Principles
As a follow-up to its Digital Decade Communication of 9 March, the Commission launched (12 May 2021) a public consultation on the formulation of a set of principles to promote and uphold EU values in the digital space. The iniziative goes also hand-in-hand with the recent proposal on Artificial Intelligence whereby the Commission aims to ensure the use of this technology in the EU is trustworthy and human-centric.

The General Services Administration recently replaced the classic version of Regulations.gov—the primary website used for accepting public comments—with a new, sleek website. This commentary assesses the modernizing efforts and suggests further ways to improve the user experience.
